3. User Obligations and Responsibilities

All projects are subject to written agreements or quotes that specify:

• Pricing and payment terms
• Timeline and completion dates
• Materials and design specifications
• Warranty and guarantee terms

Quotes are valid for the period specified in the quote document. Prices may be subject to change based on project modifications, material costs, or unforeseen circumstances. Any changes to project scope must be agreed upon in writing by both parties.

5. Payment Terms

Payment terms will be specified in your project agreement or invoice. Generally:

• Deposits may be required before work commences

All content on this website, including text, graphics, logos, images, designs, and software, is the property of Texan Wall & Floor Service or its content suppliers and is protected by United States and international intellectual property laws.

Project designs, drawings, and custom artwork created by Texan Wall & Floor Service remain our intellectual property unless otherwise agreed upon in writing. You may not use, reproduce, distribute, or create derivative works from any content without our express written permission.

You retain ownership of any materials, images, or content you provide to us for your project, and you grant us a license to use such materials solely for the purpose of completing your project.

7. Project Completion and Acceptance

Upon completion of a project, you will have a reasonable opportunity to inspect the work. Any defects or issues must be reported to us in writing within the timeframe specified in your project agreement (typically 7-14 days after completion).

We will make reasonable efforts to address any legitimate defects or issues identified during the inspection period. Acceptance of work is deemed to occur upon:

• Your written acceptance of the completed work
• Payment of final invoice
• Expiration of the inspection period without written notice of defects

8. Warranties and Guarantees

We warrant that our work will be performed in a professional and workmanlike manner using materials of good quality. Specific warranty terms will be outlined in your project agreement.

Our warranties do not cover:

• Damage caused by misuse, abuse, or neglect
• Damage caused by third parties or acts of nature
• Normal wear and tear
• Modifications made without our written approval

To the extent permitted by law, our warranties are limited to repair or replacement of defective work or materials.

9. Disclaimers

Our Services are provided "as is" and "as available" without any warranties, express or implied, except as specifically stated in these Terms or your project agreement. Texan Wall & Floor Service does not warrant that our Services will be uninterrupted, error-free, or free from viruses or other harmful components.

We disclaim all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited by law.

10. Limitation of Liability

To the fullest extent permitted by law, Texan Wall & Floor Service shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content
• Project delays or issues beyond our reasonable control

Our total liability for any claims arising from or related to our Services shall not exceed the total amount paid by you for the specific project giving rise to the claim.

13. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor strikes, government actions, pandemics, or other emergencies.

14. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or our Services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, or through the courts of Harris County, Texas, as applicable.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with your project agreement and our Privacy Policy, constitute the entire agreement between you and Texan Wall & Floor Service regarding the use of our Services and supersede all prior agreements and understandings.

17. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Your continued use of our Services after any changes to these Terms constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of our Services.
